Terms of Service

The rules for using MowNext. Written plainly, because operators should not need a lawyer just to understand what they are signing up for.

Before launch

MowNext is used as the placeholder legal entity until formation is complete. Replace this language with the final legal name and mailing address before public launch.

  • MowNext is for US lawn care operators and small crews.
  • You own your customer list, job history, invoices, photos, and exports.
  • Paid plans renew until canceled. You can cancel from billing settings without a sales call.
  • Stripe handles payments. Operators are responsible for their own customers, taxes, refunds, and service disputes.
  • SMS is service-related only. Operators must have customer consent before texting.
  • The company name, address, and Kansas legal language need attorney review before launch.

1. Who we are

These Terms are between you and MowNext. The legal entity has not been formed yet, so this page uses MowNext as a placeholder. Before public launch, this should be replaced with the final legal entity name and business mailing address.

When we say “MowNext,” “we,” “us,” or “our,” we mean the business that provides the MowNext website, app, customer portal, billing, SMS, email, and related services. When we say “you,” we mean the person or business using MowNext.

This is a working legal draft for launch preparation, not attorney-reviewed legal advice. Have a Kansas business attorney review this page before charging customers.

2. Using MowNext

MowNext is built for lawn care operators and small crews in the United States. You may use it to manage customers, properties, recurring routes, jobs, photos, estimates, invoices, payments, email, SMS, and reporting.

You agree that:

  • You are at least 18 years old.
  • You are allowed to agree to these Terms for your business.
  • You will provide accurate account, billing, business, and contact information.
  • You will use MowNext only for lawful business purposes.
  • You will follow the laws and rules that apply to your lawn care business.

3. Accounts and data

You are responsible for the users you invite, the customer data you enter, and the work your account performs. If you invite crew members, you are responsible for managing their access.

Your customer list, properties, jobs, invoices, payments, notes, photos, and exports are yours. We do not sell that data. You can export your data from the app when export tools are available, or contact us if an export tool is not ready yet.

You are responsible for having the right to add customer information to MowNext, including customer names, phone numbers, email addresses, property addresses, notes, photos, and payment preferences.

4. Plans, trials, and billing

MowNext offers a Free plan and paid plans. Current pricing is published on the Pricing page. Paid subscriptions renew monthly or annually until canceled.

New accounts may receive a 14-day trial with no card required. If you do not add a payment method before the trial ends, your account may move to the Free plan and paid features may turn off.

You can cancel from billing settings. Cancellation stops future renewal charges, but it does not automatically erase your data. See our Refund Policy for refund details.

If payment fails, Stripe may retry the charge. During a past-due period, we may limit paid features, place the account in read-only mode, or downgrade the account after the retry window.

5. Stripe payments

MowNext uses Stripe for our own subscription billing. If you accept payments from your customers through MowNext, you use Stripe Connect. Your Stripe account is yours, and Stripe may require its own onboarding, identity checks, account terms, and compliance review.

You are responsible for the services you provide to your customers, the invoices you send, the tax rates you set, customer disputes, chargebacks, refunds to your customers, tips, and whether you pass card processing fees to customers where allowed by law.

MowNext is not your accountant, tax advisor, payment processor, or collections agency. We help you create invoices and connect payment tools, but you remain responsible for running your business correctly.

6. SMS

SMS features are for service-related messages: reminders, on-the-way notices, job complete messages, invoice links, overdue invoice reminders, and two-way customer replies. MowNext does not support SMS marketing campaigns in v1.

You must have customer consent before sending SMS through MowNext. If you mark a customer as SMS-consented when they did not agree, you are responsible for that violation. We may suspend or disable SMS if we see spam, complaints, prohibited content, or compliance risk.

Customers can reply STOP or similar opt-out words. After that, SMS to that customer must stop except for a one-time opt-out confirmation. See the SMS Compliance page for the full SMS rules.

7. Customer payment links and portals

MowNext may create no-login links for estimates, invoices, and payment pages. Anyone with a valid link may be able to view the information on that page, so you should send those links only to the right customer.

We use tokens and access controls to reduce risk, but you are still responsible for the customer contact information you enter and where you send links.

8. Rules

You may not use MowNext to:

  • Break the law or help someone else break the law.
  • Send spam, marketing SMS, or messages without proper consent.
  • Upload malware, scrape the service, or try to bypass security controls.
  • Access another account or customer record without permission.
  • Harass, threaten, defraud, or mislead anyone.
  • Reverse engineer MowNext except where the law clearly allows it.
  • Use MowNext for chemical compliance workflows we do not support in v1.

9. Availability and product changes

We work to keep MowNext fast and available, but no software is online all the time. Outages, maintenance, provider issues, weather data issues, SMS filtering, email delivery problems, and Stripe downtime can happen.

We may add, change, limit, or remove features. We will try to avoid breaking core workflows without notice, but the product will evolve.

10. Warranty and liability

MowNext is provided “as is” and “as available.” To the fullest extent allowed by law, we do not make warranties about uninterrupted service, error-free operation, increased revenue, customer payment behavior, route accuracy, weather accuracy, SMS delivery, email delivery, or fitness for a particular business need.

To the fullest extent allowed by law, MowNext will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, missed routes, delayed payments, or business interruption.

To the fullest extent allowed by law, our total liability for any claim related to MowNext is limited to the amount you paid us for MowNext subscription fees in the 3 months before the event giving rise to the claim.

11. Suspension and termination

You can stop using MowNext at any time. We may suspend or terminate access if you violate these Terms, create legal risk, fail to pay, abuse SMS or email, threaten service security, or use MowNext in a way that harms other users, customers, providers, or us.

After cancellation or termination, we may keep records as needed for billing, security, tax, legal, fraud prevention, backup, and compliance purposes. You can request export or deletion as described in our Privacy Policy.

12. Governing law and disputes

This draft assumes Kansas law will govern these Terms because the founder expects to form the company in Kansas. The final venue, arbitration, class action waiver, small-claims, and consumer-law language should be reviewed by a Kansas business attorney before launch.

Until this clause is finalized, disputes should first be sent to us in writing so both sides can try to resolve the issue directly.

13. Changes to these Terms

We may update these Terms as the product, company, laws, or providers change. If a change is material, we will try to give notice by email, in-app notice, or a prominent site update before it takes effect.

Your continued use of MowNext after updated Terms take effect means you accept the updated Terms.
